ALEXANDRIA, Va.—The Vision Council has informed its members about a recent filing of a Proposition 65 Notice of Violation against a retailer in California for allegedly selling sunglasses containing BpA. Urban Outfitters Inc. was the retailer receiving the notification, according to the violation noticed posted on the California state attorney general’s website. BpA is an industrial chemical that has been used to make certain plastics and resins since the 1960s, and it is found in polycarbonate plastics and epoxy resins.

Proposition 65, or Prop 65, has been a California state law since 1986, when it was passed as the Safe Drinking Water and Toxic Enforcement Act. It is intended as a way for the state to regulate the presence of certain chemicals and to protect California's drinking water sources from contamination, according to The Vision Council.

According to The Vision Council, revised Proposition 65 warning language will go into effect Aug. 31, 2018. The revised Prop 65 language stipulates that a warning on the product must include a yellow equilateral triangle with a bold black outline, containing a black exclamation point, among other changes. Companies can voluntarily elect to follow the revised language in Prop 65 now.

The Vision Council has published a memo on its website detailing the latest changes to Proposition 65.

The Vision Council also noted that its regulatory counsel, Rick Van Arnam, will present on the Prop 65 topic at the upcoming COLA Spring meeting. The meeting runs April 26 to 27 in Temecula, Calif. Members can find more information about the COLA meeting here.
